All the same regulation apply.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>A guide to SMS opt in<\/strong><\/h2>\n\n<p>The purpose of this guide is to simplify the whole process and provide easy and actionable advice along with clear examples.<\/p>\n\n<p>Although it\u2019s comprehensive and really well laid out The\u00a0<strong><a href=\"https:\/\/ico.org.uk\/media\/for-organisations\/guide-to-pecr-2-4.pdf\">ICO guide on electronic marketing<\/a><\/strong>\u00a0runs to some 56 pages.\u00a0<\/p>\n\n<p><strong>Let\u2019s see if we can make that easier to consume<\/strong>.<\/p>\n\n<p>Before we dive in we need to understand a few key definitions or we\u2019ll be confused before we even start.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Key definitions<\/strong><\/h2>\n\n<p><strong>Marketing text<\/strong><br \/>An SMS message sent to a consumer that aims to generate or contribute to a sale of a product or service.<br \/>The ICO definition is as follows.<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cThe communication (by whatever means) of advertising or marketing material which is directed to particular individuals\u201d.<\/p>\n<\/blockquote>\n\n<p><strong>Example<\/strong><\/p>\n\n<p><strong><em>2 for 1 pizza tonight at pizza club. Any problems, please contact us 012345 67890<\/strong><\/em><\/p>\n\n<p><strong>The Privacy and Electronic Communications Regulations (PECR)\u00a0<\/strong><br \/>The PECR sets out the specific rules for communicating and marketing to people using email, SMS and phone.\u00a0<br \/>They give people specific privacy rights in relation to electronic communications and that includes SMS.<br \/>The rules for sending text are laid out in PECR regs not GDPR.<br \/>PECT regulations sit alongside the Data Protection Act and the UK GDPR.\u00a0<\/p>\n\n<p><strong>General Data Protection Regulation (GDPR)<\/strong><br \/>GDPR is the set of regulations relating to the processing of personal data. PECR relates specifically to marketing using electronic means. (email, SMS, marketing calls)<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Am I allowed to send marketing texts to my customers?<\/strong><\/h2>\n\n<p>You are permitted to send SMS texts to your customers as long as you have their permission and you can demonstrate this if you are asked.<\/p>\n\n<p>If you don\u2019t have customers\u2019 specific permission, you can still send <strong><a href=\"https:\/\/thesmsworks.co.uk\/blog\/sms-marketing\/\">customers and prospects marketing texts<\/a><\/strong> by relying on something called \u00a0the \u2018soft opt in\u2019.\u00a0<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>What is the &#8216;soft opt in&#8217;, in SMS?<\/strong><\/h2>\n\n<p>The soft opt in is where you already have the contact details of a customer but they haven&#8217;t expressly given permission to receive marketing texts.<\/p>\n\n<p>In this case, you are permitted to send marketing texts as long as you give them a chance to easily opt out. The opt out needs to be included in every texts or communication that they receive.<\/p>\n\n<p>The soft opt in assumes that customers might reasonably expect to receive marketing texts from a company that they\u2019ve recently bought from or made an enquiry to.<\/p>\n\n<p>If you rely on the soft opt in, then you need to have given customers the opportunity to opt out of receiving texts when they purchased from you or made an inquiry.<\/p>\n\n<p>For more detail \u00a0see The ICO website for the complete\u00a0<strong><a href=\"https:\/\/ico.org.uk\/for-organisations\/guide-to-pecr\/electronic-and-telephone-marketing\/electronic-mail-marketing\/#softoptin\">definition of the soft opt in<\/a><\/strong>.<\/p>\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" width=\"345\" height=\"146\" class=\"wp-image-520\" src=\"http:\/\/test.thesmsworks.co.uk\/blog\/wp-content\/uploads\/2022\/06\/papa20johns20logo.png\" alt=\"papa johns logo\" srcset=\"https:\/\/thesmsworks.wpenginepowered.com\/wp-content\/uploads\/2022\/06\/papa20johns20logo.png 345w, https:\/\/thesmsworks.wpenginepowered.com\/wp-content\/uploads\/2022\/06\/papa20johns20logo-300x127.png 300w\" sizes=\"(max-width: 345px) 100vw, 345px\" \/><\/figure>\n\n<p>Papa John\u2019s Pizza found themselves in hot water and\u00a0<strong><a href=\"https:\/\/www.theregister.com\/2021\/06\/16\/papa_johns_ico_fine\/\">facing a fine of \u00a310,000 for misuse of the soft opt<\/a>\u00a0in<\/strong><\/p>\n\n<p>Over an extended period they were sending customers promotional texts who had ordered pizza over the phone.\u00a0<\/p>\n\n<p>These customers had not been given a chance to opt out at the point at which their data was captured. So unlike people who had ordered online or via the app the soft opt in for sending messages did not apply.\u00a0<\/p>\n\n<p>Papa John&#8217;s soft in. Customers have to tick a box if they do not want to receive SMS or email marketing<\/p>\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"983\" height=\"254\" class=\"wp-image-521\" src=\"http:\/\/test.thesmsworks.co.uk\/blog\/wp-content\/uploads\/2022\/06\/Papa20Johns20soft20opt20in.png\" alt=\"Screenshot showing the opt for Papa John's pizza\" srcset=\"https:\/\/thesmsworks.wpenginepowered.com\/wp-content\/uploads\/2022\/06\/Papa20Johns20soft20opt20in.png 983w, https:\/\/thesmsworks.wpenginepowered.com\/wp-content\/uploads\/2022\/06\/Papa20Johns20soft20opt20in-300x78.png 300w, https:\/\/thesmsworks.wpenginepowered.com\/wp-content\/uploads\/2022\/06\/Papa20Johns20soft20opt20in-768x198.png 768w\" sizes=\"(max-width: 983px) 100vw, 983px\" \/><\/figure>\n\n<h2 class=\"wp-block-heading\"><strong>If I send a marketing text to an existing customer, do I need to include an opt out?<\/strong><\/h2>\n\n<p>Yes, if you send marketing texts to your customers or prospects, you need to include an easy way for them to opt out or unsubscribe from\u00a0receiving further marketing texts from your organisation.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>How often do I need to include the opt out on a marketing text?<\/strong><\/h2>\n\n<p>The opt out needs to be included in every text that you send your customers.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>How should the customer be able unsubscribe?<\/strong><\/h2>\n\n<p>In the ICO\u2019s comprehensive but dry\u00a0<strong><a href=\"https:\/\/ico.org.uk\/media\/for-organisations\/documents\/1555\/direct-marketing-guidance.pdf\">Direct Marketing Guidance PDF<\/a><\/strong>, they state:<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>\u2018It is good practice to allow individuals to reply directly to the message and opt out that<br \/>way\u2019.<\/strong><\/p>\n<\/blockquote>\n\n<p>So the ideal opt out asks the customers to reply to the text to opt out.<\/p>\n\n<p><strong>Example reply opt out text.<\/strong><\/p>\n\n<p><strong>Order any large pizza and get a second absolutely free. To opt out, reply STOP to this text.<\/strong><\/p>\n\n<p>Equally acceptable though is to include a link in the text that customer can click to unsubscribe.<\/p>\n\n<p><strong>Example opt out using a link.<\/strong><\/p>\n\n<p><strong>Order any large pizza and get a second absolutely free. To opt out, click link bit;ly\/example<\/strong><\/p>\n\n<p>To seek clarification on which opt out method is preferred by The ICO, we made contact with them to ask that specifically.\u00a0<\/p>\n\n<p>We were also interested in finding out if you could ask customers to call a number to unsubscribe.<\/p>\n\n<p>Flynn Howl, one of the ICO officers, responded.<\/p>\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"189\" height=\"189\" class=\"wp-image-525\" src=\"http:\/\/test.thesmsworks.co.uk\/blog\/wp-content\/uploads\/2022\/06\/Flynn20Howl20-20ICO.png\" alt=\"Flynn Howl ICO\" srcset=\"https:\/\/thesmsworks.wpenginepowered.com\/wp-content\/uploads\/2022\/06\/Flynn20Howl20-20ICO.png 189w, https:\/\/thesmsworks.wpenginepowered.com\/wp-content\/uploads\/2022\/06\/Flynn20Howl20-20ICO-150x150.png 150w\" sizes=\"(max-width: 189px) 100vw, 189px\" \/><\/figure>\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"385\" height=\"186\" class=\"wp-image-516\" src=\"http:\/\/test.thesmsworks.co.uk\/blog\/wp-content\/uploads\/2022\/06\/How20can20you20unsubscribe20from20SMS.png\" alt=\"which way can you unsub from marketing\" srcset=\"https:\/\/thesmsworks.wpenginepowered.com\/wp-content\/uploads\/2022\/06\/How20can20you20unsubscribe20from20SMS.png 385w, https:\/\/thesmsworks.wpenginepowered.com\/wp-content\/uploads\/2022\/06\/How20can20you20unsubscribe20from20SMS-300x145.png 300w\" sizes=\"(max-width: 385px) 100vw, 385px\" \/><\/figure>\n\n<p>So there\u2019s no specific preferred method for the text opt out as long a it is as easy as possible for the customer.<\/p>\n\n<p>Helpful Flynn also suggests that asking customers to call a number to opt out would not be acceptable.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Do I need to include an opt out on a transactional or service text?<\/strong><\/h2>\n\n<p>You do not need to include an opt out on a transactional or service text. Be aware that if your message contains a marketing element, an opt out is required. Here\u2019s another example of a service text.<\/p>\n\n<p><strong>\u201cYour order has been placed and has been dispatched for delivery. Click the link to track your package. Tracking web address.\u201d<\/strong><\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Do I need to include the opt out on a combined marketing and service text?<\/strong><\/h2>\n\n<p>Yes, The PECR is very clear that if your message includes a marketing element, then an opt out is required.<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong>\u201cIf the message includes any significant promotional material aimed at getting customers to buy extra products or services or to renew contracts that are coming to an end, that message includes marketing material and the rules apply.\u201d<\/strong><\/p>\n<\/blockquote>\n\n<p>Thinly disguised marketing won\u2019t cut it! EE found themselves on the wrong side of the rules when they tried to disguise some marketing texts as an SMS account alert.<\/p>\n\n<p>They were dealt with very harshly by the\u00a0ICO who handed out a fine of \u00a3100,000\u00a0despite their text receiving no complaints whatsoever.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>If I do include an opt out on a mixed text, am I allowed to continue to send transactional texts?<\/strong><\/h2>\n\n<p>Yes. Clubpoints.co.uk Reply STOP to optout.<\/p>\n\n<p>If the customer opts out from the text above, you can still continue to send the customer the following account-based texts, like the following example<\/p>\n\n<p><strong>You\u2019ve redeemed all your club points. Your points will refresh next Thursday.<\/strong><\/p>\n\n<h2 class=\"wp-block-heading\"><strong>How quickly does the SMS opt out\u00a0need to be implemented?<\/strong><\/h2>\n\n<p>You are required to implement the opt out immediately. You are not allowed to take as long as 30 days to process the request.<\/p>\n\n<p>When we asked the ICO specifically on this, they didn\u2019t provide a maximum time lag that would be acceptable.<\/p>\n\n<p>Again, Flynn Howl from The ICO.<\/p>\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"429\" height=\"298\" class=\"wp-image-517\" src=\"http:\/\/test.thesmsworks.co.uk\/blog\/wp-content\/uploads\/2022\/06\/How20quickly20does20opt20out20need20to20be20actioned.png\" alt=\"Advice on how quickly opt out needs to be actioned\" srcset=\"https:\/\/thesmsworks.wpenginepowered.com\/wp-content\/uploads\/2022\/06\/How20quickly20does20opt20out20need20to20be20actioned.png 429w, https:\/\/thesmsworks.wpenginepowered.com\/wp-content\/uploads\/2022\/06\/How20quickly20does20opt20out20need20to20be20actioned-300x208.png 300w\" sizes=\"(max-width: 429px) 100vw, 429px\" \/><\/figure>\n\n<h2 class=\"wp-block-heading\"><strong>Do you need to confirm to the customer that they have been unsubscribed by text?<\/strong><\/h2>\n\n<p>Sending an unsubscribe confirmation text is not required although you may wish to do so.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>A customer has chosen to unsubscribe, can I send them another text at a later date, asking if they\u2019d like to opt in again?<\/strong><\/h2>\n\n<p>No. If you send any further marketing texts after a customer has opted out, you will be in breach of the rules.<\/p>\n\n<p>Once someone has unsubscribed they should receive no further marketing texts.<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cYou must not contact them at a later date even if this is just to ask if they want to opt back in.\u201d<\/p>\n<\/blockquote>\n\n<h2 class=\"wp-block-heading\"><strong>If a customer unsubscribes to a marketing text, does that also exclude them from receiving email?<\/strong><\/h2>\n\n<p>No, When a customer unsubscribes from receiving marketing texts you are still allowed\u00a0to send them marketing emails.<\/p>\n\n<p>You do of course have to give the customer the opportunity to unsubscribe in every email that you sent them.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Are you required to state the costs of opting out by text?\u00a0<\/strong><\/h2>\n\n<p>If you are using a 5 digit short code for people to text an unsubscribe keyword to, then there is an actual cost to the customers. Texting a short code will always cost one text at the person\u2019s standard rate.<\/p>\n\n<p>Normally this is 8 &#8211; 12 pence, depending on the network.
